FULL ACQUITTAL AT COURT- MARTIAL

A Senior Non-Commissioned Officer (NCO) in the Army was accused of making a false official statement to investigators and defamatory comments about the Military. Following a week-long contested trial at court-martial, the military jury panel acquitted the service member of all charges. The NCO has since successfully been returned to a leadership position and been promoted with back pay.

SERVICE CHARGE CHARACTERIZATION WIN

Twenty-one years ago, a soldier was discharged with an under other than honorable conditions discharge. Since then, she has risen through the ranks of her industry and profession without any issue until a state questioned the meaning of her OTH discharge in lieu of court-martial, wrongly calling it a conviction and demanding she sign a settlement and withdraw her application or face adverse action. Owens Law, LLC was able to submit a brief educating the State on its misinterpretation and convincing them to award her professional license.

OFFICER RETIREMENT

An Army officer was accused of sexual contact. Owens Law attorney was able to win a retention at his Board of Inquiry (BOI) administrative separation hearing, and then fight through the retirement process with him, allowing him a full and honorable retirement.

GRADE DETERMINATION REVIEW BOARD

With the help of Owens Law, a senior officer wrongly accused of workplace environment issues survived an AR 15-6 investigation and referred officer evaluation report to earn two prestigious and challenging follow on assignments, full dismissal before hearing of the Board of Inquiry (BOI), and success at the Grade Determination Review Board (GDRB).

SEXUAL ASSAULT CHARGES DROPPED

A soldier was accused of sexually assaulting a minor. After being pressured into giving a statement to military investigators, he made statements indicating guilt after law enforcement kept urging him to confess, despite his protests. He felt the confession was coerced, but the military took him to court martial anyway. Counsel for Owens Law was able to demonstrate the unreliability of both ‘confession’ and the alleged child victim and received an alternative disposition.

MARINE GIVEN FULL RETIREMENT AND BACKPAY

 Marine was accused of sexual assault of a minor by civilian authorities and administratively separated with a General Discharge by the Corps less than two months from his approved retirement date. Owens Law was able to petition the Board of Corrections for Military Records, uncovering significant misconduct and Constitutional rights violations by the Marine Corps command, garnering him an Honorable Discharge and full retirement benefits with back pay and benefits.

An Airman was accused of sexual and physical assault while going through a divorce. Through comprehensive background work and a skillful cross-examination, the Airman was: Acquitted of All Charges, Full reinstatement, and Career back on track.

CASE DISMISSED

Owens Law represented a client in the illegal possession of a firearm. Law enforcement stopped M.R. while driving, stating he was driving erratically when the facts and video showed he was not. Counsel for Owens Law proved law enforcement was misrepresenting the facts. The stop was deemed unlawful, and the case was dismissed.

CAREER SAVED

Retention at Administrative Separation Hearing. An Army NCO was wrongly accused of sexual misconduct at a military conference. Owens Law represented the Soldier at the hearing. The board members returned a finding of unsubstantiated on all the grounds, and the service member was retained in the military.
